On Wednesday, December 3, 2008 at approximately 5:20pm , Gotcha McGillicuddy suffered an accidental self-inflicted gunshot wound to the right buttocks in a Toronto nightclub. The injury was not life-threatening, although brain damage may have been suffered, but he was released from an area hospital later that night. It is expected that he will face charges of criminal possession of a handgun. According to his lawyer Benjamin Dover, McGillicuddy will plead not guilty.It was later discovered that the Toronto PD found out about the incident only after seeing it on television and were not called by the Toronto General Hospital as required by law. Toronto Mayor David Miller called the hospital actions an "outrage" and stated that they are a "chargeable offense". Miller also urged that McGillicuddy be prosecuted to the fullest extent, calling less than the minimum 3 and a half years and a maximum of 15 years "a mockery".McGillicuddy had an expired concealed carry license from Algoma, but no Toronto license. Unlawful carrying of a handgun in Toronto carries a minimum 3 and a half year jail sentence.
