Alright GD I need your help figuring out an auto accident. To preface it, if any of you care, I'm fine. I have whiplash like a bitch and a few cuts but no concussion and I'm alive. I didn't flip my car, which is amazing given how hard the tires dug in.

So on an interstate, with a small bit of ice, I was going 55 (limit 65) in the slow lane (matching the guy to the left of me, maybe 1mph slower than the guy in front of me) when the guy in front of me drifts onto the shoulder, almost hits a stalled car, and swerves back. He slid like a motherfucker, regained, and kept going. I hit my brakes, swerved like a motherfucker, but slid across into the guard rail, bounced off, got t-boned by a guy going 50, and slid down a 12 foot embankment. Now, the guy directly in front of me, who caused all this, sped off. The guy who hit me was livid at me stopped and eventually calmed down, but did seem like he wanted to pin it on my insurance.

Questions:
1. Who is at fault? Is it genius mcfuckwad who sped away from the scene of an accident, mine, or the guy who hit me? He was supposed to be far enough back of me to stop, which he obviously wasn't.
2. I am very limited on money, I'm gunna have to scrap mine and buy the cheapest dirt car I can find. If the guy who hit me does the reasonable thing and reports it on his own insurance, I don't have to do anything further right?

You're going to have to put a claim in with your insurance, ldo

Take pictures, call your insurance if you haven't already. Pay your deductible and get your check for your car.

Care to explain why? He should have been far enough behind me to stop.

My car is a 1999, they're probably gunna tell me to eat a dick. The whole thing here is money. I was struggling to pay for school, I definitely can't replace a car yet unless my insurance people are randomly nice or I win the lotto.

Took tons of pictures, submitted the accident report online.

The guy behind me did actually corroborate that the guy in front of me swerved hard, so that's nice

Safeco. The lady I spoke to after a little fenderbender in 2008 was very bitchy and seemed to want to incriminate me.

I used to be like that. Now, I hate snow because of dumb people. It's not hard to not drift into a lane and swerve the shit out of it like you're gunna crash right in front of someone. Or maybe I shoulda just t-boned him instead.

you caused the accident. you said that you lost control and bounced off the guard rail and a guy t-boned you(which means you were sideways on a highway). if you hit your brakes and a guy ran into your rear end, that would be his fault. but you were bouncing off guard rails.......

The guy in front of me caused it by swerving in front of me. I avoided him. And the guy behind me should have had a reasonable distance behind me so as not to hit me. He didn't.

Depending on the state, probably no fault insurance in cases that are hard to determine 'fault'. Was anyone cited?

Romo is right though. They'll most likely look at the cost of damage vs blue book on the car and total it out after you pay the deductible.

No citations. The cop didn't say why, just said he wasn't going to write anyone up.

I only have liability, not full coverage. Would they still do that? Because it's really completely totaled and I'm hurting for a vehicle. Any extra money would be fantastic
