That's a very interesting case because you have two laws contradicting each other in this case, the guy's blood they wanted to draw, is a truck driver's, holding a valid CDL, by law any accident he is involved with, he has to provide blood to test.

I'm exempt but it is a giant pain in the ass to have to keep proving that every time I file the biennial report to maintain my US DOT #.

I haul my own agriculture products which consists of breeding cattle but I check several other boxes just in case. There are still agents that think I need to be in a random drug testing program and since I own the company, they believe I need to hire a 3rd party manager to randomly select me to do random drug tests.

LOL yea, that must be fun...luckily everyone I work with, hauls for contract so they KNOW they have to do the drug testing etc.

this is not my area of expertise, so i'm not saying you're wrong... but you're the first i've heard make this claim and i've found you to be quite wrong on other matters, so now i'm curious. i found this:

i see language in there where tests performed by law enforcement can serve as the tests required by the employer, but i see nothing about a driver needing to comply with tests by law enforcement (only their employer). moreover, i see nothing about consent, especially in the case of a driver who can't give any.

That's what makes this an interesting case, hospital can not force a patient to give blood against their consent, they have to have consent. Guy who is unconscious can not give consent.

Trucker involved in accident, HAS to give blood per FMSCA,

The cop/detective erred, he needed to get a warrant, which I believe is what the hospital admin on the cell was asking him to do.
